1. General Provisions
1.1. These Terms of Use (the “Terms”) govern the use of the TalentFluent online platform (the “Platform”), available at https://talentfluent.net.
1.2. The Platform is owned and operated by TalentFluent LLC.
1.3. These Terms apply to all users of the Platform: individuals (candidates) and legal entities / sole proprietors (employers, clients).
1.4. By using the Platform, the User fully and unconditionally agrees to these Terms, the Privacy Policy, and the Data Processing Agreement (DPA).
1.5. The primary governing law is the legislation of Ukraine, taking into account international standards (GDPR, CCPA, LGPD, laws of Azerbaijan and Kazakhstan).
2. Registration and Access to the Platform
2.1. Candidates receive free access to the Platform after creating an account.
2.2. Employers and clients receive free registration with the option to purchase paid service packages.
2.3. The User confirms that all information provided during registration is true and up to date.
2.4. It is prohibited to create accounts for persons who:
– are registered in or reside in the Russian Federation, the Republic of Belarus, or temporarily occupied territories of Ukraine;
– are subject to sanctions imposed by Ukraine, the EU, the USA, the United Kingdom, Canada, the United Nations, or other sanctioned jurisdictions;
– use the Platform to circumvent sanctions or on behalf of prohibited jurisdictions.
2.5. TalentFluent reserves the right to request identity or business verification from any User.
3. User Types and Access Models
3.1. Candidates may create profiles, upload resumes, apply for vacancies, and interact with employers.
3.2. Employers may create company profiles, post job vacancies, browse candidate profiles, and purchase paid packages.
3.3. The Platform does not guarantee successful hiring or employment outcomes.
4. Rights and Obligations of Candidates
4.1. Candidates must provide accurate and truthful information regarding their skills, experience, and background.
4.2. Candidates are prohibited from:
– creating fake or misleading profiles;
– providing false information;
– using the Platform for fraudulent or illegal activities.
4.3. Candidates are responsible for the content they publish and their communication with employers.
5. Rights and Obligations of Employers / Clients
5.1. Employers must ensure that job postings comply with the laws of their jurisdiction.
5.2. Employers are prohibited from posting:
– discriminatory vacancies (based on gender, age, race, religion, nationality, disability, etc.);
– vacancies related to prohibited or restricted activities (unlicensed gambling, escort services, financial schemes, illegal financial activities, sanction evasion);
– false, misleading, or fraudulent information;
– vacancies targeting sanctioned territories or jurisdictions.
5.3. Employers bear full responsibility for the accuracy and legality of all posted job information.
6. User Communication and Content
6.1. Users must adhere to ethical communication standards.
6.2. Prohibited content and actions include:
– insults, threats, harassment, or bullying;
– sexist, discriminatory, or racist expressions;
– spam or aggressive advertising;
– political or religious propaganda;
– requests for payments or services outside the Platform.
6.3. TalentFluent may remove any content that violates these Terms.
7. Prohibited Activities
Users are prohibited from using the Platform for:
– gambling without a license;
– escort or adult services;
– financial pyramids or “quick money” schemes;
– illegal cryptocurrency activities;
– trading or unlawfully distributing personal data;
– sanction evasion;
– posting vacancies that violate labor or employment laws.
8. Moderation, Blocking, and Account Removal
8.1. TalentFluent may, without prior notice:
– delete any job posting;
– limit a User’s access;
– suspend or block an account;
– permanently delete an account.
8.2. Reasons for blocking include:
– violations of the law;
– violations of these Terms;
– suspicious, fake, or fraudulent accounts;
– security risks;
– reputational risks for TalentFluent.
8.3. TalentFluent’s decisions are final.
9. Liability of TalentFluent
9.1. TalentFluent is not a party to employment relationships between employers and candidates.
9.2. TalentFluent does not guarantee employment, hiring results, the accuracy of user information, or any outcome of user interactions.
9.3. TalentFluent is not liable for:
– employer actions;
– content of job postings;
– accuracy of candidate information;
– decisions made by users based on Platform content.
10. Intellectual Property
10.1. All rights to the Platform, its design, logo, interface, structure, texts, and materials belong to TalentFluent.
10.2. Users are prohibited from copying or using Platform elements without permission.
11. Payments and Service Packages for Employers
11.1. Payments are made according to the selected plans published on the website.
11.2. Refund terms, auto-renewal rules, and complaint procedures are governed by a separate TalentFluent policy.
12. Privacy and Data Protection
12.1. By using the Platform, the User agrees to the Privacy Policy and the Data Processing Agreement (DPA).
12.2. TalentFluent processes data in accordance with Ukrainian law, GDPR, CCPA, LGPD, and the privacy laws of Azerbaijan and Kazakhstan.
12.3. Users consent to international data transfers in accordance with the Privacy Policy.
13. Termination of Use
13.1. Users may delete their accounts at any time.
13.2. TalentFluent may restrict or terminate access for violations of these Terms.
14. Dispute Resolution
14.1. Disputes shall first be resolved through negotiations.
14.2. If no agreement is reached, disputes shall be resolved in the commercial courts of Ukraine.
